ORDINANCE NO. 1452 AN ORDINANCE TO AMEND AND RE-ENACT SECTION 15-33 OF THE CODE OF THE CITY OF JAMESTOWN, NORTH DAKOTA, PERTAINING TO FIREWORKS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JAMESTOWN, NORTH DAKOTA, that Section 15-33 of the Code of the City of Jamestown, North Dakota, is hereby amended and re-enacted to read as follows: SECTION 15-33. Time and place of sale; residency requirement; special permit.
(1) No person shall offer fireworks for sale to individuals at retail within the city except during the periods of the first day of July through the fifth day of July and the twenty-sixth day of December through the first day of January.
Fireworks may be used or detonated on the first day of July through the fifth day of July and on the twenty-sixth day of December through the first day of January. The use of or detonation of any fireworks from 11:00 P.M. to 12:00 P.M. (noon) is prohibited within the City of Jamestown.
Exceptions: Fireworks may be detonated on July 4th from 12:00 P.M. (noon) to 1:00 A.M. July 5 and on December 31 from 12:00 P.M. (Noon) to 1:00 A.M. January 1.
(2) Sale of fireworks shall be allowed only in areas zoned commercial or industrial.
(3) No person shall offer any fireworks for sale unless such person is a resident of the city or living within the one-mile area under the city zoning control.
(4) The Jamestown City Council may, by resolution, allow the sale or use of fireworks at any other time or date during the calendar year. Bismarck (CSi) Fireworks sales began Saturday and continue through midnight Friday. They can be discharged from 5 p.m. New Year’s Eve to 1 a.m. New Year’s Day, after it was approved by the Legislature in 2013.
Bob’s Fireworks City, in Bismarck notes, that unlike Independence Day sales, the after-Christmas buyers tend to favor bigger fireworks over multiple smaller ones.
For a successful winter launch, owner Bob Heringer suggests revelers create a plywood base to set off their firereworks. Different municipalities have different rules on fireworks.
